Terms and Conditions

This Pet Care Service Agreement ("Agreement") is made between PAWsome Companions, LLC ("Provider") and the undersigned client ("Client") to outline the terms and conditions governing professional pet care services provided by the Provider. By utilizing the services of PAWsome Companions, LLC, the Client agrees to comply with all terms set forth in this Agreement and acknowledges their responsibilities. The Provider is authorized and entrusted to perform the services detailed herein with diligence and care. These terms apply to all pets currently owned by the Client, as well as any pets acquired after signing this Agreement, for consistent care and service standards.
1. Scope of Services: PAWsome Companions, LLC will deliver professional pet sitting, dog walking, and related pet care services with reliability, compassion, and professionalism. The Client agrees to release PAWsome Companions, LLC, including its owners, employees, contractors, and representatives, from liability except in cases of proven gross negligence or intentional misconduct. This ensures a foundation of trust and mutual responsibility.
2. Reporting Concerns: The Client must report any issues or concerns regarding services within 24 hours of their completion to facilitate prompt resolution and ensure high-quality care.
3. Payment Terms: A deposit of 50% is required at least 72 hours before services begin to confirm the booking, with the remaining balance due immediately after service completion unless otherwise agreed in writing. Any alternate arrangements must be documented and approved by both parties.
4. Accepted Payment Methods: Checks are not accepted unless explicitly approved by Provider management in advance. A $25 processing fee and any applicable bank charges will apply to returned checks to cover administrative costs.
5. Pet Safety: PAWsome Companions, LLC will take all reasonable precautions to ensure the safety and well-being of the Client's pet(s). However, the Provider is not liable for illness, injury, loss, or accidents unless caused directly by its negligence or intentional misconduct.
6. Vaccination Requirements: The Client certifies that all pets under the Provider's care are up to date on vaccinations as required by local, state, and federal laws, ensuring the safety and health of everyone involved.
7. Veterinary Emergencies: In a medical emergency, the Provider will follow instructions outlined in the Client's Veterinary Release Form. If neither the Client nor their emergency contact can be reached, the Provider will act in good faith to prioritize the pet’s immediate health and safety.
8. Client Liability for Injuries: The Client is responsible for any injuries, damages, or medical expenses caused by their pet’s behavior, including incidents involving the Provider, other individuals, animals, or property during the service period.
9. Indemnification: The Client agrees to indemnify and hold PAWsome Companions, LLC harmless from any claims or damages arising from the behavior of the Client’s pet(s) or actions taken by the Client under this Agreement.
10. Cancellation Policy: Cancellations made less than 24 hours before the scheduled service will not be eligible for a refund. Additional fees may apply if the Provider has already traveled or arrived at the Client’s location.
11. Service Termination: The Provider reserves the right to terminate services if a pet poses a threat to the safety of the Provider or others. If the Client cannot be reached, the pet will be left safely in the Client's home or secured area. Fees for completed services remain payable in full.
12. Right to Refuse Service: PAWsome Companions, LLC reserves the right to refuse service at its discretion to ensure safety, quality, and professionalism.
13. Property Access: The Provider is granted authorization to access the Client’s property exclusively for the purpose of carrying out the services that have been mutually agreed upon and explicitly detailed in this Agreement. Such access will be conducted professionally and only as necessary to fulfill the outlined responsibilities.
14. Locksmith Authorization: If access to the Client’s property is obstructed due to issues with locks or keys, the Provider is fully authorized to enlist the services of a professional locksmith for resolution. The Client agrees to promptly reimburse all associated costs within 72 hours upon receiving an invoice, ensuring uninterrupted service.
15. Criminal Activity Disclaimer: The Provider assumes no responsibility for any damages, losses, or disruptions arising from criminal activities, including but not limited to burglary or theft, that may occur during the course of service provision on the property.
16. Residence Security: It is the Client’s responsibility to ensure that their residence is adequately secured to prevent incidents such as pet escapes or unauthorized entry. The Provider will diligently re-secure the property after completing each visit to maintain safety and security.
17. Emergency and Weather Contingencies: In the event of emergencies or severe weather conditions, the Provider reserves the right to modify service schedules as needed to prioritize the welfare and safety of the pet. Outdoor activities, such as walks, may be substituted with indoor enrichment if extreme temperatures (below 50°F or above 88°F) pose a risk.
18. Property Damage: The Provider is not liable for any damages to the Client’s property that arise due to unforeseen circumstances or factors beyond its direct control during the provision of services.
19. Supplies and Equipment: The Client is required to provide all necessary supplies and equipment needed for effective pet care. Any items that the Provider must purchase on behalf of the Client are subject to reimbursement, which must be completed within 72 hours following the submission of proper documentation.
20. Media Consent: By signing this Agreement, the Client provides their consent for the Provider to use images or photos of their pet(s) for purposes such as marketing, education, or promotional activities, reinforcing a commitment to transparency.
21. Agreement Validity: This Agreement shall remain valid and enforceable for all future services rendered by the Provider, unless it is formally replaced by a newly signed written agreement between both parties.
22. Applicability to All Pets: The terms and conditions outlined in this Agreement are applicable to all existing and future pets owned by the Client, ensuring consistency and continuity of care across all services provided.
23. Training and Equipment: The Provider adheres strictly to humane training practices using positive reinforcement methods and prohibits the use of harmful tools or equipment, including but not limited to choke collars and shock collars, to ensure pet well-being.
24. Fenced Yard Disclaimer: The Provider assumes no responsibility for accidents, escapes, or other incidents that occur within fenced areas at the Client’s property. It is the Client’s obligation to maintain the fence and ensure it is secure at all times.
25. Service Schedules: Service times provided by the Provider are approximate and may vary within a two-hour time frame to accommodate factors such as travel, traffic, or other scheduling considerations without compromising service quality.
26. Emergency Contact: The Client is required to supply the Provider with contact information for a local emergency contact to address unforeseen issues related to property access or urgent decision-making during service periods.
27. Third-Party Interference: The Provider is not accountable for issues, damages, or complications caused by third parties who may enter the Client’s property during the contracted service period, as such interference is outside of the Provider’s control.
28. Behavioral Risks: The Client accepts full responsibility for any damages or injuries caused by their pet’s behavior, including interactions with other pets, people, or environmental factors, during the time services are provided.
29. Temperature Regulation: The Client must ensure the indoor temperature of their home is maintained between 68°F and 77°F for the comfort of their pets and the Provider. Adjustments to temperature settings may be made with prior notification to meet these conditions.
30. Schedule Modifications: Once services are booked and commenced, refunds will not be issued for situations such as early returns or last-minute changes to the schedule. This ensures seamless service planning.
31. Risk Acknowledgment: The Client acknowledges and accepts that despite the Provider’s best efforts to ensure safety, inherent risks, including accidents or illnesses, may still occur during the provision of services.
32. Post-Surgical Pet Policy: Any pets with unhealed surgical wounds or that are in recovery from medical procedures are ineligible for care until they have fully healed, to protect both their safety and the quality of the service provided.
33. Dispute Resolution: In the event of disagreements or disputes, both parties agree to pursue amicable resolutions through good-faith negotiations before seeking any formal legal remedies or actions.
34. Liability Coverage: To ensure liability coverage, all service bookings must be completed only through the official channels of PAWsome Companions, LLC to maintain the integrity of the Agreement.
35. Governing Law: The terms and conditions of this Agreement are governed under the laws of California, with jurisdiction specifically applying to Los Angeles, Santa Barbara, or Ventura County as relevant.
36. Liability Waiver: The Client agrees to release PAWsome Companions, LLC from liability for any issues arising during services, except in cases where gross negligence or intentional misconduct can be clearly proven.
37. Privacy Policy: The use of cameras on the Client’s property must comply with legal privacy requirements. The recording of audio during service periods is strictly prohibited, and the Client must disclose all camera locations to the Provider beforehand.
38. Authorization Continuity: By signing this Agreement, the Client grants ongoing authorization to PAWsome Companions, LLC to accept future service requests within the terms of this Agreement, eliminating the need for repeated signatures.
By signing below, the Client confirms they have reviewed, understood, and agreed to all terms of this Agreement. This document will be reviewed bi-annually to maintain mutual understanding and compliance.

; - warrant that any such Submission
are original to you or that you have the necessary rights and licenses to submit such Submissions and that you have full authority to grant us the above-mentioned rights in relation to your Submissions ; and - warrant and represent that your Submissions
do not constitute confidential information.
- Systematically retrieve data or other content from the Services to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
- Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords.
- Circumvent, disable, or otherwise interfere with security-related features of the Services, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the Services and/or the Content contained therein.
- Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Services.
- Use any information obtained from the Services in order to harass, abuse, or harm another person.
- Make improper use of our support services or submit false reports of abuse or misconduct.
- Use the Services in a manner inconsistent with any applicable laws or regulations.
- Engage in
unauthorized framing of or linking to the Services. - Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party’s uninterrupted use and enjoyment of the Services or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the Services.
- Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.
- Delete the copyright or other proprietary rights notice from any Content.
- Attempt to impersonate another user or person or use the username of another user.
- Upload or transmit (or attempt to upload or to transmit) any material that acts as a passive or active information collection or transmission mechanism, including without limitation, clear graphics interchange formats (
"gifs" ), 1×1 pixels, web bugs, cookies, or other similar devices (sometimes referred to as "spyware" or "passive collection mechanisms" or "pcms" ). - Interfere with, disrupt, or create an undue burden on the Services or the networks or services connected to the Services.
- Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the Services to you.
- Attempt to bypass any measures of the Services designed to prevent or restrict access to the Services, or any portion of the Services.
- Copy or adapt the Services' software, including but not limited to Flash, PHP, HTML, JavaScript, or other code.
- Except as permitted by applicable law, decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Services.
- Except as may be the result of standard search engine or Internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the Services, or use or launch any
unauthorized script or other software. - Use a buying agent or purchasing agent to make purchases on the Services.
- Make any
unauthorized use of the Services, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses . - Use the Services as part of any effort to compete with us or otherwise use the Services and/or the Content for any revenue-generating
endeavor or commercial enterprise. Sell or otherwise transfer your profile. Use the Services to advertise or offer to sell goods and services.
- The creation, distribution, transmission, public display, or performance, and the accessing, downloading, or copying of your Contributions do not and will not infringe the proprietary rights, including but not limited to the copyright, patent, trademark, trade secret, or moral rights of any third party.
- You are the creator and owner of or have the necessary
licenses , rights, consents, releases, and permissions to use and to authorize us, the Services, and other users of the Services to use your Contributions in any manner contemplated by the Services and these Legal Terms. - You have the written consent, release, and/or permission of each and every identifiable individual person in your Contributions to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of your Contributions in any manner contemplated by the Services and these Legal Terms.
- Your Contributions are not false, inaccurate, or misleading.
- Your Contributions are not unsolicited or
unauthorized advertising, promotional materials, pyramid schemes, chain letters, spam, mass mailings, or other forms of solicitation. - Your Contributions are not obscene, lewd, lascivious, filthy, violent, harassing,
libelous , slanderous, or otherwise objectionable (as determined by us). - Your Contributions do not ridicule, mock, disparage, intimidate, or abuse anyone.
- Your Contributions are not used to harass or threaten (in the legal sense of those terms) any other person and to promote violence against a specific person or class of people.
- Your Contributions do not violate any applicable law, regulation, or rule.
- Your Contributions do not violate the privacy or publicity rights of any third party.
- Your Contributions do not violate any applicable law concerning child pornography, or otherwise intended to protect the health or well-being of minors.
- Your Contributions do not include any offensive comments that are connected to race, national origin, gender, sexual preference, or physical handicap.
- Your Contributions do not otherwise violate, or link to material that violates, any provision of these Legal Terms, or any applicable law or regulation.
